RationaleSurrogates of critically ill patients often have inaccurate expectations about prognosis. Yet there is little research on how intensive care unit clinicians should discuss prognosis, and existing expert opinion-based recommendations give only general guidance that has not been validated with surrogate decision makers.ObjectiveTo determine the perspectives of key stakeholders regarding how prognostic information should be conveyed in critical illness.MethodsThis was a multicenter study at three academic medical centers in California, Pennsylvania, and Washington. One hundred eighteen key stakeholders completed in-depth semistructured (...) interviews. Participants included 47 surrogates of adult patients with acute respiratory distress syndrome; 45 clinicians working in study ICUs, including physicians, nurses, social workers, and spiritual care providers; and 26 experts in health communication, decision science, ethics, family-centered care, geriatrics, healthcare disparities, palliative care, psychology, psychiatry, and critical care.Measurements and main resultsThere was broad support among surrogates for existing expert recommendations, including truthful prognostic disclosure, emotional support, tailoring the disclosure strategy to each family's needs, and checking for understanding. In addition, stakeholders offered suggestions that add specificity to existing recommendations, including: In addition to conveying prognostic estimates, clinicians should help families "see the prognosis for themselves" by showing families radiographic images and explaining the clinical significance of physical manifestations of severe disease at the bedside. Many physicians did not support using numeric estimates to convey prognosis to families, whereas many surrogates, clinicians from other disciplines, and experts believed numbers could be helpful. Clinicians should conceptualize prognostic communication as an iterative process that begins with a preliminary mention of the possibility of death early in the ICU stay and becomes more detailed as the clinical situation develops. Although prognostic information should be initially disclosed by physicians, other members of the multidisciplinary team-nurses, social workers, and spiritual care providers-should be given explicit role responsibilities to reinforce physicians' prognostications and help families process a poor prognosis emotionally.ConclusionsFamily members, clinicians, and experts identified specific communication behaviors that clinicians should use to discuss prognosis in the critical care setting. These findings extend existing opinion-based recommendations and should guide interventions to improve communication about prognosis in ICUs. (shrink)

It is widely accepted that consent is a normative power. For instance, consent can make an impermissible act permissible. In the words of Heidi Hurd, it “turns a trespass into a dinner party... an invasion of privacy into an intimate moment.” In this chapter, I argue against the assumption that consent has such robust powers for moral transformation. In particular, I argue that there is a wide range of sex that harms or wrongs victims despite being consensual. Moreover, these cases (...) are not limited to those where con- sent is vitiated by background conditions. I start by calling this category of consensual sex Bad Sex. I then distinguish subspecies of this category, including psychological pressure, social coercion, and epistemically unsafe sex. I end by responding to an objection on which we should treat at least some subspecies of Bad Sex as rape. Though this alternative proposal is often motivated by ameliorative and strategic considerations, I argue that such considerations actually count against collapsing the categories of Bad Sex and rape. When we think about agents who change a long-standing belief, we sometimes have conflicting reactions. On the one hand, such agents often epistemically improve. For example, their new belief may be better supported by the evidence or closer to the truth. On the other hand, such agents are often subject to criticism. Examples include politicians who change their minds on whether climate change is occurring or whether vaccines cause autism. What explains this criticism, and is it ever justified? To answer (...) these questions, I introduce the notion of epistemic atonement. By epistemic atonement, I mean the process of making up for one’s previous epistemic failures, including believing badly. Central to my account is the idea that epistemic atonement requires restoring trust and indicating trustworthiness. I flesh out my proposal by drawing on philosophical and empirical literature on apologies, demonstrating that epistemic blame and atonement parallels the moral domain in various under-appreciated respects. This paper argues that we should replace the common classification of theories of welfare into the categories of hedonism, desire theories, and objective list theories. The tripartite classification is objectionable because it is unduly narrow and it is confusing: it excludes theories of welfare that are worthy of discussion, and it obscures important distinctions. In its place, the paper proposes two independent classifications corresponding to a distinction emphasised by Roger Crisp: a four-category classification of enumerative theories (about which items constitute (...) welfare), and a four-category classification of explanatory theories (about why these items constitute welfare). In this paper, we argue that there are epistemic norms on evidence-gathering and consider consequences for how to understand epistemic normativity. Though the view that there are such norms seems intuitive, it has found surprisingly little defense. Rather, many philosophers have argued that norms on evidence-gathering can only be practical or moral. On a prominent evidentialist version of this position, epistemic norms only apply to responding to the evidence one already has. Here we challenge the orthodoxy. First, we argue that (...) there is no significant normative difference between responding to evidence you have and gathering more evidence. Second, we argue that our practices of epistemically criticizing agents for their poor evidence-gathering indicate the existence of epistemic norms on evidence-gathering. Finally, we show that our thesis has important implications for recent debates about the relationship between epistemic norms and inquiry. (shrink)

Group-based reasons are reasons to play one’s part in some pattern of action that the members of some group could perform, because of the good features of the pattern. This paper discusses three broad conceptions of such reasons. According to the agency-first conception, there are no group-based reasons in cases where the relevant group is not or would not be itself an agent. According to the behaviour-first conception, what matters is that the other members of the group would play their (...) parts in the relevant pattern, not whether they would have the cooperative intentional states constitutive of group agency in doing so. This paper argues against these conceptions and in favour of the powers-first conception, according to which what matters is that the members of the group have practically relevant powers. (shrink)

During John Dewey's lifetime, one public opinion poll after another revealed that he was esteemed to be one of the ten most important thinkers in American history. His body of thought, conventionally identified by the shorthand word "Pragmatism," has been the distinctive American philosophy of the last fifty years. Read in isolation, H. Richard Niebuhr's Christ and Culture is seen to render a settled verdict against the sectarian anticultural type and in favour of the transformative type. But this ignores the interrelated dialectics of movement and institution, withdrawal and identification, accommodation and transformation characteristic of his critical project. It further occludes Niebuhr's variegated treatment and deployment of `the monastic' within his larger corpus, and especially in the lesser-known texts such as The Church Against the World. This essay reconsiders Christ (...) and Culture within this broader critical and textual context. It revisits the question posed in `Back to Benedict?': `It is worthwhile raising the question, therefore, whether Protestantism can and ought to continue to reject the monastic ideal out of hand'. It retrieves the full valence of hermetic, cenobitic, and mendicant forms of asceticism conflated by Niebuhr's equivocal designation of `monasticism'. In so doing, it argues for a mendicant cultural ethic which can account for the full dialectical range of Niebuhr's sectarian and transformative types within the sectarian type itself. (shrink)

This article proposes a way of understanding Kantianism, act-utilitarianism and some other important ethical theories according to which they are all versions of the same kind of theory, sharing a common structure. I argue that this is a profitable way to understand the theories discussed. It is charitable to the theories concerned; it emphasizes the common ground between them; it gives us insights into the differences between them; and it provides a method for generating new ethical theories worth studying. Palliative care is a recent branch of health care. The doctors, nurses, and other professionals involved in it took their inspiration from the medieval idea of the hospice, but have now extended their expertise to every area of health care: surgeries, nursing homes, acute wards, and the community. This has happened during a period when patients wish to take more control over their own lives and deaths, resources have become scarce, and technology has created controversial life-prolonging treatments. Palliative care is (...) therefore faced with more ethical problems that other areas of health care. This book, by a clinician, teacher, and writer on health care ethics, has been written to provide all those who care for the terminally ill--doctors, nurses, social workers, clergymen, physiotherapists--with the concepts and principles which will assist them with difficult decisions. Previous research has suggested that in cultural production fields the concatenation of eminence explains success, defined as influence and innovation. We propose that individuals in fields as diverse as philosophy, literature, mathematics, painting, or architecture gain visibility by cumulating the eminence of others connected to them across and within generations. We draw on interaction ritual chain and social movement theories, and use evidence from the field of modernist architecture, to formulate a model of how networks of very strong ties generate (...) motivations and emotional enthusiasm, change reputations, and form collective movements that over time transform the structure of cultural fields. Because major aesthetic innovations break sharply with older styles, they need very strong group solidarity over a long period of time to propagate a new standard of practice. We propose mutual halo effects, i.e., the reciprocal reinforcement of upstream and downstream prestige on a given individual node, as the key factor accounting for success in a cultural production field. We discuss the relevance of these results for building a model of influence and innovation in cultural production fields in which networks—reshaped by shifting technological, political, and economic conditions—trigger new styles. This paper examines the idea of an extended unit of action, which is the idea that the reasons for or against an individual action can depend on the qualities of a larger pattern of action of which it is a part. One concept of joint action is that the unit of action can be extended in this sense. But the idea of an extended unit of action is surprisingly minimal in its commitments. The paper argues for this conclusion by examining (...) uses of the idea of an extended unit of action in four theoretical contexts. It also explains why the idea of an extended unit of action need not involve magical thinking, and discusses possible replies to an objection based on a worry about recklessness. (shrink)

This paper aims to solve a puzzle for instrumental conceptions of epistemic normativity. The puzzle is this: if the usefulness of epistemic norms explains their normative grip on us, why does it seem improper to violate these norms even when doing so would benefit us? To solve this puzzle, we argue that epistemic instrumentalists must adopt a more social approach to normativity. In particular, they should not account for the nature of epistemic normativity by appealing to the goals of individual (...) agents. Rather, they should appeal to norms or rules of inquiry that serve our collective goals. We argue that epistemic normativity grows out of our need to promote a deep kind of coordination in our basic epistemic practices. By subscribing to an appropriate system of norms, we can coordinate epistemic rule-following across the community. This makes testimony more trustworthy and reliable. This account not only solves a puzzle about epistemic instrumentalism but also sheds new light on the foundations of normativity and emphasizes the need for a truly social epistemology. (shrink)

It begins with a brief history of early Western propaganda, including Ancient Greek classical theories of rhetoric and the art of persuasion, and traces its development through the Christian era, the rise of the nation-state, World War I, Nazism, and Communism. The core of the book examines the ethical implications of various forms of persuasion, not only hate propaganda but also insidious elements of more generally acceptable communication such as advertising, (...) public relations, and government information, setting these in the context of freedom of expression. Propaganda and the Ethics of Persuasion examines the art of persuasion but it also hopes to establish a "self-defense" resistance to propaganda. As Jacques Ellul warned in 1980, any new technology enters into an already existing class system and can be expected to develop in a way favourable to the dominant interests of that system. The merger of AOL and Time-Warner confirms the likelihood of corporate interests dominating the future of the Internet, but the Internet has also opened up new possibilities for a politically effective counter-culture, as was demonstrated at the meeting of the World Trade Organization in Seattle in late 1999 and numerous similar gatherings since. In paradigmatic cases of subtweeting, one Twitter user critically or mockingly tweets about another person without mentioning their username or their name. In this chapter, we give an account of the strategic aims of subtweeting and the mechanics through which it achieves them. We thereby hope to shed light on the distinctive communicative and moral texture of subtweeting while filling in a gap in the philosophical literature on strategic speech in social media. We first specify what subtweets are and identify (...) the central features that give rise to their strategic mechanics. Next, we draw attention to problematic aspects of subtweeting and consider conditions under which subtweeting can be justified on moral and prudential grounds. In Queer Social Philosophy, Randall Halle analyzes key texts in the tradition of German critical theory from the perspective of contemporary queer theory, exposing gender and sexuality restrictions that undermine those texts' claims of universal truth. Taking the possibility of visual argumentation seriously, this essay explores how refutation might proceed. We posit three ways in which images can refute and be refuted in a mixed-media environment: (1) dissection, in which an image is broken down discursively; (2) substitution, in which one image is replaced within a larger visual frame by a different image; and (3) transformation, in which an image is recontextualized in a new visual frame. This paper connects two ideas. The first is that some common responses to ethical views are responses to their degrees of pragmatism, where a view’s degree of pragmatism is its sensitivity to ethically relevant changes in the actor’s circumstances. I claim that we feel the pull of opposing pro-pragmatic and antipragmatic intuitions in certain cases. This suggests a project, of searching for an ethical view capable of doing justice to these opposing intuitions in some way. The second central idea is (...) that a theory of pattern-based reasons looks more promising than the obvious alternatives to fulfil this role, amongst Teleological theories at least. Pattern-based reasons are reasons to perform some action because of the goodness or rightness of a larger pattern of action—such as a pattern that a group could perform or that the actor could perform over an extended period—of which the immediate action is a mere part. Existing theories of such reasons share two features that prevent them explaining the intuitions we wish to explain: they consider only one pattern at a time (they are monist), and they treat patterns as eligible only if the agents concerned are willing to realise them (they accept the Willingness Requirement). But we need not accept these doctrines. Moreover, a theory of patternbased reasons without them is able to explain the pro- and anti-pragmatic intuitions in an elegant way, and has other attractive features. (shrink)

This book expounds and defends a new conception of the relation between truth and meaning. Atlas argues that the sense of a sense-general sentence radically underdetermines its truth-conditional content. He applies this linguistic analysis to illuminate old and new philosophical problems of meaning, truth, falsity, negation, existence, presupposition, and implicature. In particular, he demonstrates how the concept of ambiguity has been misused and confused with other concepts of meaning, and how the interface between semantics and pragmatics has been misunderstood. In this paper I argue for the Atlas-Kempson Thesis that sentences of the form The A is not B are not ambiguous but rather semantically general (Quine), non-specific (Zwicky and Sadock), or vague (G. Lakoff). This observation refutes the 1970 Davidson-Harman hypothesis that underlying structures, as full semantic representations, are logical forms. It undermines the conception of semantical presupposition, removes a support for the existence of truth-value gaps for presuppositional sentences (the remaining arguments for which are viciously circular), and lifts (...) the Russell-Strawson dispute of 1950–1964 from stalemate to a formulation in which a resolution is possible for the first time. Suggestions of Davidson, Montague, Stalnaker, Kaplan and H. P. Grice are shown to be inadequate semantic descriptions of negative, presuppositional sentences. I briefly discuss the radical Pragmatics view of my 1975 publications and suggest that it too fails to do justice to the linguistic data. I speculate that Semantic Representations should be given the form (more or less) of computer programs, describable in Dana Scott's mathematical semantics for programming languages. (shrink)

This fresh look at the philosophy of language focuses on the interface between a theory of literal meaning and pragmatics--a philosophical examination of the relationship between meaning and language use and its contexts. Here, Atlas develops the contrast between verbal ambiguity and verbal generality, works out a detailed theory of conversational inference using the work of Paul Grice on Implicature as a starting point, and gives an account of their interface as an example of the relationship between Chomsky's Internalist Semantics (...) and Language Performance. Atlas then discusses consequences of his theory of the Interface for the distinction between metaphorical and literal language, for Grice's account of meaning, for the Analytic/Synthetic distinction, for Meaning Holism, and for Formal Semantics of Natural Language.
